The regulations concerning open work visas in New Zealand will be revised starting 20 April 2026. These adjustments define two distinct employment categories that will impact those engaged in business and holders of working holiday visas. Here’s what newcomers should be aware of.

If you’re in possession of an open work visa for New Zealand, it’s important to stay informed. Starting on 20 April 2026, the government will implement modifications to the work conditions associated with these visas.

The objective is straightforward: clarify what types of work are permissible, reducing ambiguity for migrants and potential confusion for employers.

What Is an Open Work Visa?

An open work visa permits you to be employed by nearly any company, across various roles throughout New Zealand. You are not required to secure a job offer prior to application. This contrasts with employer-specific visas, like the Accredited Employer Work Visa, which restricts you to a single employer and position.

It is important to emphasize that the upcoming changes won’t impact employer-specific visas. Furthermore, these new stipulations do not pertain to Student Visa holders.

Two Variants of Open Work Visa Conditions

Changes to open work visas from April 2026

Beginning April 2026, every open work visa will be categorized into one of two types.

1. Open Work Visas That Permit Any Employment

If your open work visa permits you to engage in any form of work, you are qualified to:

  • Be employed by an organization
  • Operate as self-employed
  • Manage your own business

This encompasses:

  • Partner of a Worker Work Visa
  • Partner of a Student Work Visa
  • Partner of a Student Work Visa supported by a New Zealand Scholarship
  • Post Study Work Visa
  • Partner of a New Zealander Work Visa
  • Partner of a Military Work Visa

2. Open Work Visas That Mandate Employment with an Employer

  • Securing an employment contract, or
  • A service agreement

In either situation, this is classified as employment within New Zealand. Establishing your own business is not permitted under this category.

  • Victims of Domestic Violence Work Visa
  • Victims of People Trafficking Work Visa
  • Migrant Exploitation Protection Work Visa
  • Asylum Seeker Work Visa
  • All Working Holiday Visas

Universal Rules for All Open Work Visa Holders

  • You must adhere to New Zealand’s employment and business regulations
  • You are prohibited from employing others, even through a business you own
  • Engaging in commercial sexual services is not allowed
  • You cannot manage or invest in a business offering commercial sexual services

These limitations apply universally.

Currently Engaged in Work That Might Not Be Permissible?

The intent is to provide individuals with adequate time to adapt. You can evaluate your circumstances, modify your work arrangements if necessary, and prepare thoroughly before submitting your application for the next visa.

However, upon reapplication, you must comply with the updated employment criteria associated with your visa category.

Implications for Working Holiday Participants

However, starting from April 2026, you will be required to work for an employer. Running a business or acting as an independent business owner will not be permitted.

For the majority of travelers, there will be no changes. For individuals freelancing or working autonomously, this is a significant consideration.
